Schwab Industries, Inc. and several of its affiliates commenced chapter 11 cases in the United States Bankruptcy Court for the Northern District of Ohio on February 28, 2010. The cases are being jointly administered under case number 10-60702. The Honorable Russ Kendig, United States Bankruptcy Judge, is presiding over the cases. The Schwab Debtors include the following entities: - Schwab Industries, Inc. (Case No. 10-60702) - Medina Cartage Co. (Case No. 10-60703) - Medina Supply Company (Case No. 10-60704) - Quality Block & Supply, Inc. (Case No. 10-60705) - O.I.S. Tire, Inc. (Case No. 10-60706) - Twin Cities Concrete Company (Case No. 10-60707) - Schwab Ready-Mix, Inc. (Case No. 10-60708) - Schwab Materials, Inc. (Case No. 10-60709) - Eastern Cement Corp. (Case No. 10-60710) On December 15, 2010, the Bankruptcy Court entered an order (the “Confirmation Order”) confirming the First Amended Joint Plan of Liquidation of Schwab Industries, Inc., et al. (the “Plan”). Pursuant to the confirmed Plan, substantially all of the remaining assets of the Debtors have been transferred to a Creditor Trust. John B. Pidcock has been appointed the initial Creditor Trustee of the Creditor Trust, and he has retained Freeborn & Peters LLP as his lead counsel. Among other things, the Creditor Trustee has been granted the authority to: (1) liquidate remaining assets of the estates; (2) reconcile and object to claims filed or scheduled in the Debtors’ cases; (3) pursue estate causes of action – including avoidance actions under Chapter 5 of the Bankruptcy Code – for the benefit of creditors; and (4) distribute estate assets to holders of allowed claims in accordance with the Plan. The Creditor Trustee’s activities will be governed by an Oversight Committee, consisting of representatives of the Debtors and the Official Committee of Unsecured Creditors formed during the Debtors’ chapter 11 cases.
