Duke and King Acquisition Corp. and several of its affiliates commenced chapter 11 cases in the United States Bankruptcy Court for the District of Minnesota on December 4, 2010. The cases are being jointly administered under case number 10-38652. The Honorable Gregory F. Kishel, United States Bankruptcy Judge, is presiding over the cases.

On December 29, 2010, an Official Committee of Unsecured Creditors (the “Committee”) was appointed in the case in accordance with section 1102(a) of the U.S. Bankruptcy Code. Freeborn & Peters LLP was retained as counsel to the Committee on December 31, 2010, and its application for approval as Committee counsel was approved on January 14, 2011. Freeborn & Peters has established this website, at the Committee’s request, in accordance with section 1102(b)(3) of the Bankruptcy Code to provide information to creditors and solicit and receive comments from creditors.
